MAD SCIENCE TACTICAL INNOVATIONS, LLC (“MST”) welcomes you into our family of customers. All users of this site agree that access to and use of this website, www.madsciencetactical.com (the “Site”), are subject to the following terms and conditions and other applicable law contained herein (the “Terms”). If you do not agree to these terms and conditions, please do not use this Site.
Disclaimer
By accessing or using the website, you confirm that you are 21 years of age and older and there are no local, state or federal laws prohibiting you from purchasing, receiving or owning products available for sale on the Site.
Website Use Not for Individuals Under the Age of 21
The MST website is available to registered and unregistered users who are 21 years of age and older. MST reserves the right to revoke the ability to access the products and services offered on the website for any reason at any time, including as a result of a violation of these Terms or the Privacy Policy, without notice. Use of the website is void where prohibited by law.
Terms and Conditions
All customers must agree to MST’s statements and terms of sale before an order is placed. All orders are subject to review and approval by MST.
Customer Affirms:
1. I am a U.S. citizen. I am not an illegal or unlawful alien.
2. I am currently 21 years of age or older.
3. By selling or delivering a product to me, MST is not violating any state or local law or ordinance.
4. I am not under indictment for and have never been convicted in any court of law of a crime punishable by imprisonment for over a year.
5. I am not a fugitive from justice of any kind.
6. I am not an unlawful user or addicted to any controlled substance.
7. I have not been adjudicated as mentally ill, and I have not been committed to any mental institution of any kind.
8. I have never been nor am I expected to be discharged from the Armed Forces under dishonorable conditions of any kind.
9. I have not renounced my U.S. citizenship.
10. I am currently not subject to any restraining order.
11. I have never been nor am I expected to be convicted in any court of a misdemeanor or felony crime of domestic violence.
12. I will use products purchased from MST for lawful purposes only.
Certification of Compliance
Customer understands and acknowledges that certain state and local laws may prohibit or restrict the purchase, sale, transfer, or possession of certain firearm parts, components, and/or accessories that you may purchase from MST. In some instances, the violation of these laws can constitute a crime. Customer understands and acknowledges that MST will not sell or transfer certain firearm parts, components and/or accessories unless Customer agrees to identify and fully comply with state and local law regarding the purchase, sale, transfer, or possession of such items. Customer understands, agrees and acknowledges that it is Customer’s sole responsibility to identify any state and local laws that may prohibit or restrict the purchase, sale, transfer, or possession of certain firearm parts, components, and/or accessories that you may purchase from MST, and, if at any time a MST product is sent to Customer that is unlawful for Customer to possess, for any reason whatsoever, Customer shall immediately notify MST.
Shipping Information
Orders for products generally ship UPS, FedEx or USPS Mail. MST reserves the right to change and alter shipping methods from those selected at checkout without notice.
Return Policy (30-day guarantee)
MST offers a thirty (30) day (from the date of purchase), no questions asked, return policy on undamaged and unaltered products only. Returns are not accepted past this time. For items that have been used and have damage or alterations, please see the MST Warranty terms. All returns must include the original order confirmation and invoice (if one was provided), along with the billing address, shipping address, contact phone numbers, contact email, and Return Merchandise Authorization (“RMA”) number. You must contact MST by email or phone at 424-419-2641 to obtain this number prior to the expiration of the 30-day return term. Returns without an RMA number will not be processed. Returns may take two (2) weeks or more to fully process.
Shipping charges and costs are your responsibility and not subject to refund. Products that are not subject to this return policy are those sold “as is”, “damaged” or “altered” as determined in the sole discretion of MST, or where it is otherwise stated that the product is not subject to this return policy at the time of purchase. All returns are subject to a 15% restocking fee.
Refunds
All products must be packed in the original packaging, including any accessories, manuals, documentation, and registration that shipped with the product. Once your return is received and inspected, we will notify you via email that we have received your return item. If your return is approved, all refunds will be paid in U.S. dollars and credited to the customer’s account (credit card/original method of payment) that was used at the time of purchase. To receive a refund, the product(s) must be received within thirty (30) days of the purchase date.
Warranty, Limitations & Disclaimer of Liability
Limited Lifetime Warranty: MST goods are warranted to be free from defects in material and workmanship for the life of the product(s). MST agrees to correct, by repair or replacement with a new or comparable model, a qualifying product without charge, if returned to MST. Parts used for replacement are warranted hereunder for the remainder of the original warranty period. This warranty does not apply to the normal wear and tear of any parts or surface finish of any materials used in the product. This warranty does not cover defects in products that have been modified or altered from their original state. This warranty does not cover defects in products that have been repaired outside of MST’s facilities. This warranty does not cover defects resulting from the physical abuse to, or misuse of, the product or its operation in a manner contrary to the included instructions, including, but not limited to, failure to properly maintain the product. This warranty does not cover repairs related to reasonable use, corrosion, or damage/loss suffered during return shipment. This warranty is null and void if the product has been misused, damaged (by accident or otherwise), used in a manner not consistent with the instructions, used with a firearm that it is not designed to be used with or compatible with, or if unauthorized repair or alteration has been done to the product, including of a cosmetic nature.
MST reserves the right to inspect the product before making replacements or repairs covered by this warranty. Proof of purchase is required for all warranty claims. This warranty grants specific legal rights to the original retail purchaser only and is not transferrable. Other rights may apply and vary from state to state.

This Limited Lifetime Warranty has been drafted in compliance with the Magnuson-Moss Warranty Federal Trade Commission Improvement Act.

MST shall not be liable for personal injury from the use of the product unless such injury was due to willful fault or gross negligence of MST. MST assumes no responsibility for product malfunction, physical injury, or property damage resulting in whole or in part from criminal use, or negligent, improper, or careless handling, unauthorized modifications, unauthorized installation or assembly, abuse, neglect, or any other influences beyond MST’s control. Under no circumstances shall MST be held liable for incidental or consequential damages with respect to economic loss, injury or property damage resulting from the breach of any express or implied warranty; this limitationdoes not apply to states that disallow the exclusion of consequential or incidental damages. The user assumes all risks as to the performance of the product. If the product is purchased for a specific use, the user and not MST, is solely responsible for the determination of the fitness or suitability of the product for such use. THERE ARE NO WARRANTIES, WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY DISCLAIMED. At all times the first concern of every firearm owner should be safety. Follow all instructions on the proper handling and safe use of this product, or any firearm accessory/component.You should seek formal training BEFORE using the product. If you feel uncertain about any operational aspects of your product, please contact us BEFORE proceeding with its operation. MST strongly recommends a certified gunsmith install its products. If you the consumer choose to install a MST product on your own, you do so at your own risk.YOU MUST FOLLOW ALL OF THE INCLUDED SAFETY RULES TO ENSURE THE SAFE USE OF YOUR PRODUCT. THE FAILURE TO FOLLOW ALL INSTRUCTIONS, RULES, AND WARNINGS, OR IF THIS PRODUCT IS CARELESSLY OR IMPROPERLY HANDLED, COULD RESULT IN INJURY OR DEATH TO YOU OR OTHERS AND/OR DAMAGE TO PROPERTY.
Protocol // Grip 001 Warning(s) & Notice(s)
You are responsible for reading and understanding all instructions contained with the Mad Science Protocol // Grip 001 (the “Product”) to ensure proper use. Improper or careless use of firearm or its components, parts, and accessories may result in serious injury or death. You should first seek formal training before utilizing this Product with a loaded firearm.
At no time should a firearm other than the make and model of gun for which the Product is made be used with the Product. The use of the Product is done solely at the risk of the user. If you have purchased a Product from MST, the Product is designed to be used with a 1911 model firearm only, please consult the user’s manual for compatible models. THIS PRODUCT IS DESIGNED TO BE USED FOR COMPETITIVE PURPOSES ALONE. THIS PRODUCT SHOULD NEVER BE USED WITH A FIREARM CARRIED ON A PERSON FOR DEFENSIVE PURPOSES (i.e CONCEALED CARRY). Be advised, even in a competitive environment the risk of serious injury or death still exists by using this Product. Those risks can never be completely eliminated.
You should be aware that the use of the Product may increase your risk of liability to include, but not limited to, Negligence, Accidental Discharge, Negligent Entrustment, Criminal Liability, and Civil Liability. It is always YOUR responsibility to ensure the safe and legal use and operation of the Product. The use of the Product may render yourfirearm warranty or any relevant insurance null and void. It is your responsibility to know and understand your firearm warranty(s) and insurance coverages. MST is not responsible for the voiding of any warranty, guarantee, or insurance coverage provided by the firearm manufacturer or other third parties.

Errors and Omissions
MST makes every effort to have accurate and complete information on our Site, including but not limited to pricing, availability, and product features, however, we occasionally make mistakes. Customer agrees that they will not hold MST liable for such mistakes or omissions and acknowledges that orders may be canceled after the fact due to errors or omissions.
If an item is missing from your order, you must contact MST within five (5) days of receipt of shipment.

Agreement to Indemnify and Defend for Misrepresentation
In the event that any of the above statements are determined to be untrue, you agree to indemnify and defend MST, and its owners, agents, officers, and employees against any resulting civil liability or criminal prosecution.
Release of Liability and Agreement to Indemnify and Defend
By placing an order with MST, you explicitly agree to release MST from any and all liability arising from or related to the Products purchased to include, but not limited to, the use of the Product, the storage of the Product, and the transportation of the Product. You also acknowledge that you are responsible for how you use the product and any third-party use. In the event that any other party files a claim of any kind against MST, you will indemnify and pay to defend MST and its owners, agents, officers, and employees against any resulting civil liability or criminal prosecution

Jurisdiction
You agree that if you, or someone else affected by your use of any product purchased from MST, brings a legal claim of any kind against MST, or any of its owners, agents, officers, or employees, that such legal action must be filed in Federal Court in the United States District Court for the Northern District of Ohio located in Akron, Ohio. You also agree that any complaints filed within any other jurisdiction shall be immediately terminated and moved to the Federal Court in the United States District Court for the Northern District of Ohio located in Akron, Ohio, and agree to reimburse MST and its owners, agents, officers, and employees for any costs they may each incur in defending against the complaint or effecting its removal until such time that the complaint is properly filed in the Federal Court in the United States District Court for the Northern District of Ohio located in Akron, Ohio.

MST reserves the right, in its sole discretion, to change the Terms under which www.madsciencetactical.com is offered. The most current version of the Terms will supersede all previous versions. MST encourages you to periodically review the Terms to stay informed of our updates.
